Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Faith On Stage B.V. ("Faith On Stage", "we", "us", or "our"), a company registered in the Netherlands, governing your access to and use of the Faith On Stage platform, website, and related services (collectively, the "Platform").
By registering an account, accessing the Platform, or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Platform.
2. Types of Users
The Platform supports three primary user roles, each with distinct rights and responsibilities:
Each user is individually responsible for all activity conducted under their account. Organisations are additionally responsible for ensuring all persons acting on their behalf comply with these Terms.
3. User Accounts
To access the Platform's core features, you must register for an account. By creating an account, you represent and warrant that:
- You are at least 18 years of age.
- You have full legal capacity to enter into binding contracts.
- All registration information you provide is accurate, complete, and current.
- You will maintain the security of your password and immediately notify us of any unauthorised use.
- You will not create more than one account per individual or organisation.
- You are not prohibited from using the Platform under applicable law.
Faith On Stage reserves the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Booking Process
The Platform facilitates bookings between Organisations and Artists. The following process governs all bookings made through Faith On Stage:
- Organisations submit a formal Booking Request specifying event details, date, location, expected audience size, and proposed fee.
- Artists may accept, decline, or propose counter-terms within the Platform's messaging system.
- Upon mutual agreement, both parties sign a digital Contract within the Platform. This contract is legally binding under applicable electronic signature laws.
- The Organisation makes full payment into the Faith On Stage escrow system via Stripe Connect.
- Faith On Stage releases funds to the Artist 7 days after the confirmed event date, subject to no disputes being raised.
- Both parties are required to submit a mutual review within 14 days of the event.
Faith On Stage acts solely as a technology intermediary and is not a party to any contract between Artists and Organisations. We do not guarantee the quality, safety, or legality of any service booked through the Platform.
5. Payments, Fees & Escrow
Platform Fee: Faith On Stage charges a service fee of 10% of the Artist's agreed rate, capped at a maximum of €249 per booking. This fee is added on top of the Artist's rate and charged to the Organisation — it is never deducted from the Artist's payout. The Artist always receives 100% of their agreed fee. This fee is non-negotiable.
Payment Processing: All payments are processed through Stripe Connect. By using the Platform, you agree to Stripe's Terms of Service and Privacy Policy. Faith On Stage does not store payment card details.
Escrow: Upon booking confirmation, the Organisation's payment is held in escrow. Funds are released to the Artist 7 days after the event date, provided no dispute has been raised. In the event of a dispute, funds remain held until the dispute is resolved by Faith On Stage.
Subscriptions: Artists may subscribe to Pro (€19/month) or Featured (€49/month) plans. Subscriptions are billed monthly and are non-refundable for partial periods. Subscription fees are separate from and in addition to the 10% booking fee.
Taxes: Users are solely responsible for reporting and paying any applicable taxes on income earned or services received through the Platform. Faith On Stage will collect VAT where required by Dutch or EU law.
6. Cancellations & Refunds
Cancellation terms are primarily governed by the digital contract signed by both parties. In the absence of specific contract terms, the following default policy applies:
The platform service fee is non-refundable in all cancellation scenarios. Refunds are processed within 5–10 business days via the original payment method.
7. Artist Obligations
Artists using the Platform agree to:
- Provide accurate, up-to-date profile information including performance samples, pricing, and availability.
- Respond to booking requests within 48 hours.
- Honour all accepted bookings and arrive on time for all confirmed events.
- Perform the agreed service to a professional standard.
- Notify the Organisation and Faith On Stage as soon as possible in the event of an emergency preventing performance.
- Maintain any required licences, permits, or professional registrations for their art form.
- Ensure all content on their profile (photos, videos, audio) does not infringe third-party intellectual property rights.
- Not solicit Organisations to conduct future bookings outside the Platform for a period of 12 months following any Platform-facilitated introduction.
8. Organisation Obligations
Organisations using the Platform agree to:
- Provide accurate event details including date, location, duration, expected audience size, and technical requirements.
- Ensure a safe, appropriate, and faith-affirming environment for all performances.
- Make full payment into escrow within 48 hours of contract signing.
- Notify Artists of any material changes to event details promptly.
- Provide agreed-upon equipment, sound systems, or technical support as specified in the booking contract.
- Not contact or book Artists discovered through the Platform outside of the Platform for a period of 12 months following any Platform-facilitated introduction.
- Handle any required event permits, insurance, or CCLI/music licensing independently of Faith On Stage.
9. Verification & Reviews
Artist Verification: Artists may apply for a Verified badge by submitting identity documents and professional credentials. Verification is at Faith On Stage's sole discretion. Verification indicates identity confirmation only and does not constitute an endorsement of performance quality.
Mutual Reviews: Following each completed booking, both parties are invited to submit a review. Reviews are released simultaneously only after both parties have submitted, or after 14 days (whichever comes first). Reviews must be honest, accurate, and respectful. Faith On Stage reserves the right to remove reviews that contain false statements, personal attacks, or violate these Terms.
Users must not offer, solicit, or accept incentives in exchange for positive reviews. Manipulated reviews may result in account suspension.
10. Prohibited Uses
You may not use the Platform to:
- Post false, misleading, or fraudulent information.
- Impersonate any person or organisation.
- Harass, threaten, or harm other users.
- Transmit spam, unsolicited messages, or promotional communications.
- Circumvent the Platform's payment system to conduct bookings off-platform.
- Upload content that infringes copyrights, trademarks, or other intellectual property rights.
- Distribute malware, viruses, or malicious code.
- Scrape, harvest, or systematically collect data from the Platform.
- Use automated bots or scripts to interact with the Platform.
- Post content that is sexually explicit, hateful, or promotes violence.
- Post content that contradicts the Christian faith values upon which this Platform is founded.
- Train generative artificial intelligence models using Platform content or data.
11. Intellectual Property
Platform IP: All Platform technology, design, trademarks, and content created by Faith On Stage remain the exclusive property of Faith On Stage B.V. You may not copy, reproduce, modify, or distribute any Platform IP without our express written permission.
User Content: You retain ownership of all content you upload to the Platform (profile photos, videos, audio samples, bio text). By uploading content, you grant Faith On Stage a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content on the Platform and in marketing materials.
DMCA / Copyright Complaints: If you believe content on the Platform infringes your copyright, please contact us at legal@faithonstage.com with a description of the work, the infringing URL, and your contact details. We will investigate and respond within 5 business days.
12. Dispute Resolution
Between Users: If a dispute arises between an Artist and an Organisation, either party may escalate it to Faith On Stage within 3 days of the event. During the dispute period, escrowed funds are held.
Faith On Stage will review submitted evidence from both parties and issue a binding decision within 14 days. Our decision regarding escrow release is final.
With Faith On Stage: Any dispute between a User and Faith On Stage shall first be submitted to mediation. If mediation fails, disputes shall be resolved by binding arbitration under the Dutch Arbitration Institute (NAI) rules, seated in Amsterdam, Netherlands, conducted in English.
You waive any right to participate in class-action proceedings against Faith On Stage.
13. Termination
You may close your account at any time via Account Settings. Upon closure:
- Any pending bookings and escrowed funds will be processed according to the applicable cancellation policy.
- Your public profile will be removed within 30 days.
- Your personal data will be retained for 12 months for legal and dispute resolution purposes, then deleted.
- Subscription fees for the current billing period are non-refundable.
Faith On Stage may suspend or permanently terminate your account, at our sole discretion, for any violation of these Terms, without notice and without refund. We reserve the right to refuse service to anyone for any lawful reason.
14. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Faith On Stage does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
Faith On Stage is not responsible for the conduct of any Artist or Organisation. We do not vet, verify, or endorse any user beyond the explicit Verification badge process. We strongly recommend that Organisations conduct their own due diligence on Artists before booking.
Faith On Stage is not a party to booking contracts between Artists and Organisations. We are not liable for any failure to perform, cancellation, or dispute arising from such contracts.
15. Limitation of Liability
To the maximum extent permitted by Dutch law, Faith On Stage's total liability to you for any claim arising from your use of the Platform shall not exceed the greater of:
- The total platform fees paid by you in the 12 months preceding the claim, or
- €100.
Faith On Stage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or reputational harm, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. For EU consumers, mandatory consumer protection provisions of your country of residence also apply.
Subject to the arbitration clause in Section 12, any legal proceedings shall be brought exclusively in the courts of Amsterdam, Netherlands.
If you are an EU resident and have a complaint, you may also contact the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
17. Changes to These Terms
Faith On Stage reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email to your registered address and a prominent notice on the Platform.
Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform and close your account.
